Le terme tenure désigne un mode de concession d'une terre.<\/SPAN><\/P>

Aux fins de l\u2019application de l\u2019article 26 de la Loi sur les terres du domaine de l'État (L.R.Q., chapitre T-8.1), l\u2019arpenteur général du Québec a déterminé que les terres ayant un CARACTÈRE PUBLIC sont celles sous l\u2019autorité des :<\/SPAN><\/P>

  • Ministères du gouvernement du Québec établis par la Loi sur les ministères (L.R.Q., chapitre M-34);<\/SPAN><\/P><\/LI>

  • Organismes gouvernementaux qui figurent sur la liste produite par le Secrétariat aux emplois supérieurs du ministère du Conseil exécutif du Québec.<\/SPAN><\/P><\/LI><\/UL>

    Les terres considérées comme ayant un CARACTÈRE PRIVÉ au Registre du domaine de l\u2019État (RDE) sont celles qui ne sont pas sous l\u2019autorité des ministères ou organismes gouvernementaux et qui ont fait l\u2019objet d\u2019une concession<\/SPAN>. <\/SPAN>En conséquence, les immeubles appartenant, entres autres, aux entités administratives suivantes ne sont pas considérés comme ayant un caractère public :<\/SPAN><\/P>

    • Communautés métropolitaines;<\/SPAN><\/P><\/LI>

    • Municipalités;<\/SPAN><\/P><\/LI>

    • MRC;<\/SPAN><\/P><\/LI>

    • Sociétés de transport en commun<\/SPAN>;<\/SPAN><\/P><\/LI>

    • Commissions scolaires;<\/SPAN><\/P><\/LI>

    • CEGEP et universités;<\/SPAN><\/P><\/LI>

    • Centres hospitaliers et centres d\u2019hébergement;<\/SPAN><\/P><\/LI>

    • CLSC<\/SPAN>;<\/SPAN><\/P><\/LI>

    • Centres de réadaptation;<\/SPAN><\/P><\/LI>

    • Centres de protection de l\u2019enfance;<\/SPAN><\/P><\/LI>

    • Gouvernement du Canada.<\/SPAN><\/P><\/LI><\/UL>

      Il en est de même pour les immeubles appartenant aux filiales d\u2019organismes gouvernementaux suivantes :<\/SPAN><\/SPAN><\/P>

      • Filiales de la Caisse de dépôt;<\/SPAN><\/P><\/LI>

      • Filiales d\u2019Investissement Québec;<\/SPAN><\/P><\/LI>

      • Filiales de la Société nationale du cheval de course;<\/SPAN><\/P><\/LI>

      • Filiales de la Société des loteries du Québec;<\/SPAN><\/P><\/LI>

      • Filiales de la Société générale de financement du Québec.<\/SPAN><\/P><\/LI><\/UL>
